Above Health – Device Use Agreement

This Device Use Agreement governs your use of Above Health’s devices, including but not limited to smart inhalers, monitoring tools, and related accessories. By using our devices, you agree to comply with the terms outlined below.



1. Intended Use

Our devices are designed to assist in monitoring and managing allergy and asthma conditions. They are not intended to diagnose, cure, or prevent disease without supervision from a licensed healthcare provider.


2. User Responsibilities
  • Read and follow all provided user manuals and safety instructions.
  • Keep devices clean and properly maintained.
  • Do not modify, tamper with, or attempt repairs unless explicitly authorized.

3. Warnings and Limitations
  • Improper use may result in inaccurate readings or device malfunction.
  • The device is not a substitute for clinical judgment; always consult your provider for medical advice.
  • Do not share personal devices with others to avoid cross-contamination.

4. Data Collection and Privacy

Device data may be collected and transmitted to Above Health’s secure platform for monitoring and analysis. All data is handled in accordance with our Privacy Policy and relevant laws, including HIPAA.


5. Warranty and Support

Devices come with a 30-day limited warranty covering manufacturer defects only. Warranty claims must be submitted within the warranty period. For support, contact our team at support@above.health.


6. Limitation of Liability

To the fullest extent permitted by law, Above Health disclaims liability for indirect, incidental, or consequential damages arising from device use, except as required under applicable law.


7. Governing Law

This agreement is governed by the laws of the State of California. Any disputes will be resolved in accordance with the dispute resolution terms set out in our Terms of Service.
